Privacy policy of internet shop Zolline.com


1. General provisions

1.1 The administrator of personal data collected through the Online Shop is MARCIN WESOŁOWSKI, running a business activity under the name CONCEPT JEWELRY MARCIN WESOŁOWSKI (address of the principal place of business: Łozy 9E/10; 80-516 Gdańsk; workshop address and correspondence address: ul. Ludowa 4; 80-279 Gdańsk) entered in the Business Activity Central Register and Information Record kept by the minister in charge of the economy, NIP taxpayer’s number 5831169170, REGON statistical number 191861969, e-mail address: cpt@cptjewelry.com; registry number of the personal Trader number submitted to the Regional Assay Office in Gdańsk: 10551 - henceforth referred to as the ‘Administrator and being at the same time the Online Shop Service Provider and the Trader.
1.2 Personal data of the Service User (Customer) is processed pursuant to the Personal Data Protection Act os August, 29th 1997 (Journal of Laws of the Republic of Poland No 133, item 883, as amended) and the Act on provision of service by electronic means of July, 18th 2002 (Journal of Laws of the Republic of Poland No 144, item 1204, as amended).
1.3 The Administrator exercises the highest degree of diligence in order to protect the interest of the persons, whom the data concerns and especially they assure that the data they collect is processed in accordance with the law; collected for defined, lawful purposes and not processed further in a manner not compliant with those purposes; that the data content is correct and adequate to the purpose for which it is processed and kept in a manner allowing for the identification of persons, whom the data concerns, not longer than it is necessary for the purpose of processing the data.
1.4 All words, expressions and acronyms written on this site and beginning with a capital letter (e.g. Trader, Online Shop, Electronic Service) shall have the meaning given to them in the Online Shop Terms and Conditions, available at: http://www.zolline.com/Obsluga-klienta,Regulamin.html.

2. Purpose and extent of gathering data
2.1. The purpose of gathering data by the Administrator is to:

1.1. establish, define the provisions, amend, execute or dissolve a contractual relationship between the Service Provider (Trader) and the Service User (Customer) comprising the provision of Electronic Services by the Online Shop or the conclusion and performance of a Products Sale Contract and delivery of the Products to the Customer.
1.2 document the contractual relationships, mentioned in point 2.1.1 for evidential purposes for the period of limitation of claims associated therewith.   

2.2. In the case of Customers who use electronic payments through the Payu.pl or Paypal.pl services, the Administrator submit the collected Customers’ personal data solely to the settlement agent selected by the Customer and only to the extent which is necessary for the Customer to execute payment through the agent. The settlement agent available at the Online Shop is:

1.3. Paypal.pl – the PayPal company (Europe) S.à r.l. & Cie, S.C.A., 5. floor 22–24 Boulevard Royal, L-2449, Luxembourg.
1.4. Payu.pl - the PayU S.A. with its registered office in Poznań (registered office address: ul. Grunwaldzka 182, 60-166 Poznań), entered in the Register of Entrepreneurs of the National Court Register under the the number 0000274399, registry documents kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, share capital PLN 4,000,000 fully paid up, NIP: 779-23-08-495.

2.3 In the case of Customers, who use the service of Product Delivery to the Customer, the Administrator submit the collected personal data of the Customers to the extent necessary to perform delivery to the selected carrier:  

1.4.1. POCZTA POLSKA SA with its registered office in Warsaw (registered office address: ul. Rakowiecka 26, 00-940  Warszawa) number in the Register of Entrepreneurs of the National Court Register: KRS 0000334972.
1.4.2. UPS Polska Sp. z o.o. with its registered office in Warsaw (registered office address: ul. Prądzyńskiego 1/3; 01-222 Warszawa), number in the Register of Entrepreneurs of the National Court Register: KRS 0000036680.

2.4 The Administrator process the following personal data of the Service Users (Customers): name and surname; e-mail address; contact phone number; addresss (street, house number, apartment number, post code, city, country).
2.5 Providing the personal data mentioned in point 2.4 is necessary for the Service Provider to provide Electronic Services within the Online Shop or to conclude a Products Sale Contract.
2.6 The Administrator gather automatically the data included in the Cookie files during the use of the Online Shop website. These are text files recorded at the Service User computer during the use of the Online Shop (they allow, among others, to remeber the basket contents). The Cookies mechanism is not used to obtain any information concerning the Online Shop Service Users or to trace their navigation. It is possible to prevent the gathering of data included in the Cookie files by using the proper functions of the Internet browser (concerning this we refer you to the browser’s help file or recommend to contact its provider).


3. Basis for data processing
3.1 Using the Online Shop and concluding Contracts for the provision of Electronic Services by the Online Shop or Products Sale Contracts, which is associated with the necessity of providing personal data, is absolutely voluntary.  The person, whom the data concerns, decide themselves, if they want to start using Electronic Services provided by the Service Provider or to conclude a Sale Contract pursuant to the Shop Terms and Conditions.
3.2 Pursuant to art. 23 of the Personal Data Protection Act of August, 29th 1997 (Journal of Laws of the Republic of Poland, Item 883, as amended), the processing of data is admissible among others in case:
  1.5 the person, whom the data concerns, gives consent to it, unless it concerns the deletion of the data concerning them.
1.6. it is necessary to perform a Contract, to which the person, whom the data concerns is a party or when it is necessary to take action prior to concluding a Contract, upon the request of the person, whom the data concerns.
3.3 The processing of personal data by the Administrator always takes place within the bases for its admissibility listed in point 3.2. hereof Processing the data shall be associated with performing a Contract or the necessity to take action prior to concluding a Contract, upon the request of the person, whom the data concerns (point 3.2.2.). Moreover, prior to concluding Contracts for the Electron Services provision, a future Service User (Customer) is informed about the necessity to accept the Terms and Conditions.
 
4. The right to control, access and correct a person’s data.
4.1 A Service User has the right to access their personal data contents and to correct it.
4.2 Each person is entitled to control the processing of data that concerns them, contained in the Administrator’s database and particularly the right to: 
1.7. Demand to supplement, update, rectify personal data, temporarily or permanently refrain from processing it or to delete it if it is incomplete, outdated, false or has been collected in violation of the act or it is no longer necessary for the performance of the purpose for which it was collected.
4.3 In order to exercise the rights mentioned in points 4.1 and 4.2 a person may use the options in the Account or send a proper message by electronic mail to the address: cpt@cptjewelry.com or in writing to the Administrator’s address.

5. Final Provisions
5.1 The Online Shop may contain links to other websites. The Administrator bears no responsibility for the privacy policies used by those websites. The Administrator recommends that after accessing other websites, you get to know the privacy policy the websites. This privacy policy concerns solely the Online Shop.
5.2 The Administrator use technical and organisational means assuring the protection of the processed personal data, adequate to the threats and the category of data protected and particularly they protect the data against being made available to unauthorised persons, collecting by an unauthorised person, processing in breach of the mandatory provisions of law and modifying, loss, damage or destruction.
5.3 The Service Provider provides the following technical measures preventing the gathering and modifying of personal data sent electronically by unauthorised persons:

1.8. Encryption of data used for the Service User authorisation.
1.9. Protection of the database against unauthorised access.
1.10. Access to the account only after providing an individual login and password set up by the Service User.

5.4 To all matters not settled herein, the provisions of the Online Shop Terms and Conditions and other applicable provisions of the Polish law shall apply.
